Cupertino-based company originally sued Motorola Xoom tablet is believed to be infringing or to imitate the three design patents Apple iPad to continue in court. But on Tuesday in the German Court has stated that the Motorola Xoom tablet does not infringe the patent Apple iPad three designs. Fox Business reported.

While the ruling party favored by Motorola, the court rejected the company's claim that Apple's design patent was invalid. Cupertino-based company is also seeking an injunction barring the sale of Motorola slate throughout Europe.

The Court ordered Apple to pay two-thirds of the associated court costs and ordered Motorola to pay the remaining third. Design violations in just one category of intellectual property disputes ongoing between major technology players in Germany and around the world.
